张庆方律师：The Disparities｜西南财大、华东政法与百年老校南京大学相比，差距在哪里？

因为代理鹰潭吴敏案，本人盯上了甘为鹰犬、铁了心帮着江西纪委干脏活构陷吴敏的鹰潭中院副院长刘赛连。

Because of my involvement in the Wu Min case in Yingtan, I focused on Liu Sailian, the vice president of the Yingtan Intermediate Court, who zealously assisted the Jiangxi Commission for Discipline Inspection in framing Wu Min.

查到刘赛连在南京大学骗取的在职法律硕士学位，学位论文抄袭率竟高达63.9%后，我们马上于2024年1月25日举报到南京大学学位办，接待到现场的金磊律师的南京大学学位办的老师态度很好：你来的晚了，现在学校已经放寒假，不可能召集学术委员专门开会，我们会在开学后处理，处理结果会通知你。

After discovering that Liu Sailian had fraudulently obtained an in-service Master of Laws degree from Nanjing University, with a plagiarism rate as high as 63.9%, we immediately reported it to the Nanjing University Degree Office on January 25, 2024. The staff at the Degree Office, who received attorney Jin Lei on site, were very polite: "You came too late, the school is already on winter break. We can't convene an academic committee now, but we will handle it after the semester starts and notify you of the results."

元宵节过后，直到三月下旬，我们多次电话问询对刘赛连论文的调查结果，南京大学学位办的人均说还没有消息。为此，本人于2024年4月8日发表致南京大学校长谈敏哲的公开信《我从未想到百年老校也如此不知羞耻》，这篇文章被大量转载后，南京大学的工作人员说：举报刘赛连的事，我们在开学后就立即启动了调查，因为有一个月的初查期，初查后，已经于3月11号立案，调查期间三个月，6月11号前出结果。对级别高得多的，我们撤销论文的多了，没有袒护刘赛连的道理。

After the Lantern Festival, until late March, we repeatedly called to inquire about the investigation results of Liu Sailian's thesis. The staff at the Nanjing University Degree Office always said there was no news. Therefore, on April 8, 2024, I published an open letter to President Tan Minzhe of Nanjing University titled "I Never Thought a Centenarian School Would Be So Shameless." After this article was widely reprinted, Nanjing University's staff said: "Regarding the report on Liu Sailian, we initiated the investigation immediately after the semester started. Since there is a one-month preliminary investigation period, after which the case was officially filed on March 11, the investigation period is three months, and the result will be out before June 11. We have revoked many theses for those with much higher ranks than Liu Sailian; there's no reason to protect her."

结果，金磊律师果然于调查期限届满前一天，收到了南京大学的邮件回复，认定刘赛连的硕士论文存在抄袭，构成学术不端。

As a result, on the day before the investigation deadline, attorney Jin Lei indeed received an email reply from Nanjing University, confirming that Liu Sailian's master's thesis was plagiarized and constituted academic misconduct.

与南京大学的态度相比，西南财经大学就差多了。本人为前内江经开区工委书记赵永韦辩护时，发现制造这起假案的内江纪委书记王阿冤在西南财经大学的MBA论文，知网查询抄袭率达到52.2%，个别章节竟达到86.2%，遂于2023年12月25号通过西南财经大学校长邮箱举报。其后，国内多家媒体对王阿冤论文抄袭做了报道，也联系到了西南财大，但是，这家二流大学拒不和我联系，拒不调查处理。本人遂于2024年1月11日发表公开信《西南财经大学李永强校长，你文人士大夫的风骨哪里去了?》，敦促李永强校长有点骨气，不要面对一个区区副厅级，就丧失一个大学校长应有的尊严。

Compared to Nanjing University's attitude, Southwest University of Finance and Economics (SWUFE) was much worse. While defending Zhao Yongwei, the former secretary of the Neijiang Economic Development Zone Work Committee, I found that Neijiang Commission for Discipline Inspection Secretary Wang Yuan, who fabricated this false case, had an MBA thesis at SWUFE with a plagiarism rate of 52.2%, and some chapters reached 86.2%, according to a CNKI check. Therefore, I reported it to the SWUFE president's email on December 25, 2023. Subsequently, many domestic media outlets reported on Wang Yuan's plagiarism and contacted SWUFE, but this second-rate university refused to contact me or investigate the matter. Consequently, on January 11, 2024, I published an open letter titled "President Li Yongqiang of Southwest University of Finance and Economics, Where Is Your Scholarly Integrity?" urging President Li Yongqiang to have some backbone and not lose the dignity of a university president when facing a mere deputy division-level official.

但是至今，六个月过去了，西南财大依然不敢对阿冤的论文造假说不。

However, to this day, six months later, SWUFE still does not dare to say no to Wang Yuan's thesis fraud.

但是不论如何，西南财大面对国内媒体，好歹还是承认收到了对王阿冤的举报，也表示会按程序处理，这也算保住了一所二流大学的底线。

But in any case, SWUFE, facing domestic media, at least admitted receiving the report on Wang Yuan and stated it would handle the matter according to procedures, which at least maintains the baseline for a second-rate university.

与西南财大相比，华东政法，这所如假包换的三流大学，面对学术造假举报，态度就只能用混账形容了。同样在鹰潭案中，我们发现伙同刘赛连一起作恶的鹰潭中院院长田甘霖，在华东政法的在职硕士论文，抄袭率38%，遂于2024年4月8日去华东政法举报，华东政法学位办的几个女人恶声恶气地对举报人说：这事不归我们管，你们去找纪委！本人于2024年4月9日发表公开信《看法盲的华东政法学位办如何保护剽客校友田甘霖》后，华东政法学位办的几个女人改变了态度，表示欢迎举报。

Compared to SWUFE, East China University of Political Science and Law (ECUPL), a truly third-rate university, has a reprehensible attitude towards academic fraud reports. Similarly, in the Yingtan case, we found that Tian Ganlin, president of the Yingtan Intermediate Court, who colluded with Liu Sailian, had an in-service master's thesis at ECUPL with a plagiarism rate of 38%. Therefore, we reported it to ECUPL on April 8, 2024. Several women at the ECUPL Degree Office rudely told the whistleblower: "This is not our responsibility; go to the Commission for Discipline Inspection!" After I published an open letter on April 9, 2024, titled "See How the Law-Illiterate ECUPL Degree Office Protects Plagiarist Alumni Tian Ganlin," these women changed their attitude and said they welcomed reports.

但是，一个月后，举报人再次登门，询问对田甘霖的举报，学校有没有调查，结果如何时，学位办的人一改以前的态度：你们提供的田甘霖论文造假材料，真假都搞不清楚。再说了，你们拿知网上的查重结果举报，也不行，我们要求必须有手工比对的结果，你们还要先保证拿到的是田甘霖本人的硕士论文。华东政法的硕士论文，学位从未授权任何机构拿到网上去，你们是怎么得到的？如何保证是真的？

However, a month later, when the whistleblower revisited to inquire about the investigation into Tian Ganlin's report, the staff at the Degree Office reverted to their previous attitude: "We can't even determine the authenticity of the materials you provided on Tian Ganlin's thesis fraud. Moreover, using CNKI's plagiarism check results to report is not acceptable; we require manual comparison results. You must first ensure that you have obtained Tian Ganlin's actual master's thesis. ECUPL has never authorized any institution to put its master's theses online. How did you get it, and how can you guarantee its authenticity?"

听到好歹也是一方法律院校的工作人员面对学术造假举报，竟然如此扯她娘的蛋，举报人彻底懵了：这就是华东政法的水平？这是个学法律的人该说的话？

Hearing the staff of a so-called law school talk such nonsense in response to an academic fraud report left the whistleblower utterly dumbfounded: Is this the level of ECUPL? Is this something a law-educated person should say?

但是，实际的华东政法，就是这个档次！虽然也是五大政法院校之一，但是，华政既没中国政法大学的地域优势，也无西南政法厚重的底蕴，同时，因为地处大上海，好多老师心思也全在挣钱上。因此，这些年，这个学校，真是没出什么一流的学者，没任何一流的成果。甘于三流的华东政法，面对学术举报，有这种态度，也就不足为奇了。

But in reality, ECUPL is just at this level! Although it is one of the top five political and law universities, ECUPL neither has the regional advantage of China University of Political Science and Law nor the profound heritage of Southwest University of Political Science and Law. Moreover, because it is located in Shanghai, many teachers are more focused on making money. Therefore, in recent years, this school has neither produced any first-rate scholars nor any first-rate achievements. It is not surprising that ECUPL, content with being third-rate, has such an attitude towards academic fraud reports.

西南财大包庇王阿冤，还情有可原。因为，阿冤是四川纪委书记的红人，随时回省纪委，掌握西南财大领导的生杀大权，对这种厂卫当红人员，一个二流大学，确实腰杆硬不起来。但是，华东政法对一个贫困地区的中院院长的学术造假，为什么要包庇？其实，这不难理解。华政就是法律圈炮制假文凭的工厂，虽然学校不能靠批发学位在账外收钱，这些年下来，多少校领导，院长负责人，导师，教辅人员，靠着这个利益链捞足了！真的把田甘霖的学位取消了，他一气之下，说不定就把华政一大拨人供出来。一个三流大学，敢冒这么大的风险吗？

SWUFE's protection of Wang Yuan is somewhat understandable. Wang is a favorite of the Sichuan Commission for Discipline Inspection, and he could return to the provincial Commission for Discipline Inspection at any time, wielding life-and-death power over SWUFE's leadership. For a second-rate university, it is indeed hard to stand firm against such a powerful figure. But why would ECUPL protect the academic fraud of a president from a poor district's intermediate court? Actually, it is not hard to understand. ECUPL is essentially a factory for fabricating fake diplomas in the legal circle. Although the school cannot make money off the books by wholesale degrees, over the years, many school leaders, deans, responsible persons, supervisors, and teaching staff have profited from this interest chain! If they really revoked Tian Ganlin's degree, he might get angry and expose a whole bunch of people at ECUPL. Would a third-rate university dare to take such a big risk?

因此，观察南京大学、西南财大、华东政法面对学术不端举报的态度，谁是一流，谁是二流，谁是三流，就一清二楚了。

Therefore, by observing the attitudes of Nanjing University, SWUFE, and ECUPL towards academic fraud reports, it becomes clear who is first-rate, who is second-rate, and who is third-rate.
