张庆方律师：桂林公安再次被纪委的手段深深折服：又被他们弄傻一个！ The Guilin Public Security Has Once Again Been Deeply Impressed by the Tactics of the Discipline Inspection Commission: Another One Rendered Insane by Their Coercion. ——桂林赵继红案真相之二 ——The Truth About the Zhao Jihong Case in Guilin, Part Two

2024年1月17号，前桂林交投集团董事长赵继红，在被桂林纪委专案组惨无人道地折磨了整整半年后，终于走出了他在桂林留置中心的人间地狱（赵继红被桂林纪委逼供诱供的详细情况，见本人2024年3月5日文章《赵继红在桂林留置中心的人间地狱》）。

On January 17, 2024, Zhao Jihong, former chairman of the Guilin Transportation Investment Group, finally emerged from the hellish Guilin Detention Center after being inhumanely tortured for six months by the Guilin Discipline Inspection Commission's special task force (for detailed accounts of Zhao Jihong's forced confessions by the Guilin Discipline Inspection Commission, see my article from March 5, 2024, "Zhao Jihong’s Living Hell at the Detention Center").

离开留置中心的当天早晨，催赵继红收拾个人物品的看守脸色异样地问：知道你要去什么地方吗？赵继红略带疑惑地回答：回家啊？看守给了他一个意味深长的怪笑:你是要回家了！

On the morning he left the detention center, the guard who urged Zhao Jihong to pack his belongings asked him oddly, "Do you know where you're going?" Zhao, slightly confused, replied, "Home?" The guard gave him a meaningful, strange smile: "Yes, you're going home!"

结果，出了纪委留置中心的大门，迎面遇上的，是桂林市公安局的警车，车子开到桂林市看守所门口，负责办理换押手续的桂林市公安局刑侦支队的一个警察问赵继红：知道你涉嫌什么罪名吗？已经半年没理发没刮胡子，看上去活脱脱一个野人的赵继红一脸茫然地摇摇头：不知道。这个警察又追问：知道你涉及多少数额吗？赵继红继续摇头：不知道。刑侦支队的警察扭头冲着桂林市检察院的检察官一个苦笑：又被他们（桂林纪委）弄傻了一个！

As a result, upon exiting the gates of the Discipline Inspection Detention Center, he was met with a police car from the Guilin Public Security Bureau. The car stopped at the Guilin Detention Center where a police officer from the Criminal Investigation Division handling the custody transfer asked Zhao Jihong, "Do you know what crime you're suspected of?" Zhao, who hadn't shaved or cut his hair for six months and looked like a wild man, shook his head blankly: "I don't know." The officer asked again, "Do you know how much money is involved?" Zhao continued to shake his head: "I don't know." The officer from the Criminal Investigation Division then turned to a prosecutor from the Guilin Prosecutor's Office and said with a bitter smile, "Another one rendered insane by their coercion!"

已经被桂林纪委专案组高强度地讯问了半年的赵继红，真的不知道他会被移送司法，真不知道他涉嫌的罪名和犯罪数额吗？真的。因为，在被留置的前两个月，专案人员廖勇、蒋金林、陆自强等人渣反复强调：我们查了一圈，你这个人，还是比较严谨的。尤其十八大以后，真的没什么事。我们是真的没证据，有证据，早把你拍死了，还有必要在这里天天陪你聊天？你比那些人强多了！但是，你也不想想，你得罪了谁，才把自己弄到这里来的？你也是个正处级干部，不是主要领导的意思，我们敢动你？！

After being intensely interrogated by the Guilin Discipline Inspection Commission's task force for half a year, did Zhao Jihong really not know that he would be transferred for prosecution, or the crimes and amounts he was suspected of? Indeed, he did not. In the first two months of his detention, team members Liao Yong, Jiang Jinlin, and Lu Ziqiang repeatedly emphasized: "We've looked into it, and you're a relatively meticulous person. Especially after the 18th National Congress, there's really nothing on you. If we had any evidence, we would have 'killed' you long ago; would we still need to sit here chatting with you every day? You're much better than the others! But think about it, who did you offend to end up here? You're a senior official, and without the top leader's directive, would we dare touch you?!"

在蒋金林、廖勇、陆自强口中，纪委是政治机关，不讲法律不讲证据，赵继红是否真的贪腐不重要，事实不重要，让主要领导满意，才唯一重要。蒋金林一脸痞子样地问赵继红：你知道外边人都怎么骂我们纪委吗？地痞流氓加仇人！这又怎么样?抓谁，放谁，整多大，还不是我们说了算？我们整成啥样，检察院法院敢放个屁！

In the words of Jiang Jinlin, Liao Yong, and Lu Ziqiang, the Discipline Inspection Commission is a political body that doesn't care about the law or evidence. Whether Zhao Jihong was really corrupt is irrelevant, the facts are irrelevant, satisfying the top leader is all that matters. Jiang Jinlin, with a ruffian's look, asked Zhao Jihong: "Do you know how people outside curse our Commission? 'Hooligans and enemies!' What about it? Who we arrest or release, how much we charge, isn't it all up to us? No matter how we handle it, would the Prosecutor's Office or the courts dare to fart?"

蒋金林的国家流氓形象，让赵继红都不得不提醒他：你可是对着摄像头呢！蒋金林、廖勇浪声大笑：摄像头？我们这里还算文明的！我们去中纪委办过大案，那里，可比这里厉害多了！

Jiang Jinlin's image as a national thug forced Zhao Jihong to remind him: "You are on camera!" Jiang Jinlin and Liao Yong burst into laughter: "Camera? We are still considered civilized here! We've handled major cases at the Central Discipline Inspection Commission, and it's far more severe there!"

对于陆自强、蒋金林、廖勇等人调查了多少人，安在自己头上多少事，多大金额，赵继红是真不清楚。他只知道，专案组进驻桂林交通集团后，对每一位女同志，都反复问和赵继红有没有不正当男女关系，有几个女同事被这些流氓问哭了。对于和交投集团合作过的每一个民营老板，专案组都反复逼问和赵继红之间有没有不正当经济往来。其中，一个叫周华林的商人，因为承包了交投集团下属单位的物业，从未和赵继红谋面的他，竟被纪委关了两个月，逼他承认向赵继红行贿四百万。桂林伍建集团的老总，被纪委关了一个多月，还免去了他的秀峰区人大代表职务，逼他承认向赵继红行贿。按专案组声称民营老板们已经交代，逼赵继红必须配合的全部数额，赵继红至少受贿一个亿。

Zhao Jihong was genuinely unaware of how many people Lu Ziqiang, Jiang Jinlin, and Liao Yong investigated, how many cases they attributed to him, or the amounts involved. He only knew that after the task force moved into the Guilin Transportation Group, they repeatedly questioned each female colleague about any improper relations with Zhao Jihong, causing several of them to cry. Every private business owner who had dealings with the Transportation Group was repeatedly coerced into admitting financial misconduct with Zhao Jihong. One businessman named Zhou Hualin, who had never met Zhao but contracted a property from a subsidiary of the Transportation Group, was detained by the Commission for two months, forced to confess to bribing Zhao with four million yuan. The CEO of Guilin Wu Jian Group was detained for over a month and stripped of his position as a People's Representative for Xiufeng District, forced to admit to bribing Zhao. According to the task force, the private business owners had confessed, and Zhao Jihong was forced to cooperate, implicating him in receiving bribes totaling at least one hundred million yuan.

但是，蒋金林等人同时又告诉赵继红：数额就不是个事，也不会真的给你认。只要在主要领导那里能过得去就行！2023年中秋节，纪委常委刘凌更是亲口保证：主要领导已经决定给你一条出路，只要你态度好，配合调查，就给你“断崖式处理”，董事长你就想都不要想了，但是，还能保住公职，有个饭碗。

However, Jiang Jinlin and others also told Zhao Jihong: "The amount doesn't matter, and we won't really hold you to it. As long as it's acceptable to the top leadership, you're fine!" On Mid-Autumn Festival in 2023, Liu Ling, a member of the Discipline Inspection Commission, personally assured him: "The top leadership has decided to give you a way out. As long as you have a good attitude and cooperate with the investigation, you'll be 'cliff-processed'—forget about being the chairman, but you can still keep your public position and have a livelihood."

有了廖勇陆自强蒋金林等人的忽悠和刘凌常委的保证，赵继红就开始了和专案组的讨价还价，整个过程中，完全没有任何对事实和证据的尊重，全和自由市场上买衣服，菜市场买大葱一样。比如：对于赵继红不熟悉，没有私下往来，但和交投集团有业务往来的商人孙建平，专案组一开始要求赵红红拿出诚意，给一个符合你这个级别这个位子的数，让主要领导满意。赵继红说：三十万吧。蒋金林诚恳地说：你这么大一个领导，三十万，我都觉得寒碜，六十万吧。等做好笔录两天后，蒋金林又来找赵继红：主要领导对这个数很不满意，要求不能低于两百万。一心争取“断崖式处理”的赵继红，只好按蒋金林传达的主要领导的要求，改口说孙建平给过我两百万。赵继红在桂林纪委的每一份笔录，都是办案人员按主要领导的要求，自己口述，让赵继红照着复述，最后形成笔录的，其中记录的，不是什么犯罪事实，而是厂卫时代的特有荒诞！

With the cajoling from Liao Yong, Lu Ziqiang, Jiang Jinlin, and the assurances from Committee Member Liu Ling, Zhao Jihong began bargaining with the task force. The entire process showed no respect for facts or evidence, much like bargaining in a free market or at a vegetable market. For example, with businessman Sun Jianping, whom Zhao did not know personally but had business dealings with the Transportation Group, the task force initially asked Zhao to show sincerity and propose a number that fit his position to satisfy the top leader. Zhao suggested: "Three hundred thousand." Jiang Jinlin earnestly replied: "For a leader of your stature, three hundred thousand is too meager, let's say six hundred thousand." Two days after recording this, Jiang Jinlin came back to Zhao: "The top leader is not satisfied with this figure, it cannot be less than two million." Desperate for a "cliff treatment," Zhao had to change his statement to match the top leader's demand, claiming Sun Jianping had given him two million. Every statement Zhao made at the Guilin Discipline Inspection Commission was dictated by the officers according to the top leader's requests, for Zhao to repeat and be recorded, capturing not the facts of any crime, but the absurdity characteristic of a certain era.

就这样，2024年1月10号，案件移送司法的前一周，专案组要求赵继红给妻子写一封信：配合退赃。并承诺，退赃后，你就可以回家了。

Thus, on January 10, 2024, a week before the case was transferred to the judiciary, the task force asked Zhao Jihong to write a letter to his wife: to cooperate in returning the loot. They promised that after returning it, he could go home.

这才有了在桂林看守所门口，面对桂林市公安局和市检察院的人，赵继红对自己已经被移送司法不知道，涉嫌什么罪名不知道，被控多少金额不知道的一幕。

This led to the scene at the entrance of the Guilin Detention Center, where facing the officials from the Guilin Public Security Bureau and the Prosecutor's Office, Zhao Jihong was unaware that he had been transferred to the judiciary, unaware of the crimes he was suspected of, and unaware of the amounts he was accused of.

桂林纪委如此明目张胆地做假案，是谁的授意，谁在给他们撑腰？这在桂林纪委的移送起诉意见书中已经露出端倪：

With the Guilin Discipline Inspection Commission so blatantly fabricating cases, whose directive is it, and who is backing them? Clues have already emerged in the prosecution recommendation letter from the Guilin Discipline Inspection Commission:

本人代理过几十起纪委办理的案件，还是第一次，纪委的起诉意见书中，出现“经市委主要领导批准”的记载，这分明就是桂林纪委专案组要保留证据：我们也是被逼的，赵继红这个案子是市委主要领导定的。

I have represented dozens of cases handled by the Discipline Inspection Commission, but this is the first time that the prosecution recommendation letter includes a record "approved by the main leader of the Municipal Committee." Clearly, the Guilin Discipline Inspection Commission's task force is preserving evidence: We were also compelled; the case against Zhao Jihong was dictated by the main leader of the Municipal Committee.
