张庆方律师向鹰潭纪委举报吴文兆律师 Lawyer Zhang Qingfang reports Lawyer Wu Wenzhao to the Yingtan Discipline Inspection Committee.

本人是北京市汉鼎联合律师事务所张庆方律师，在鹰潭中院目前正在审理的前吉安人大主任吴敏受贿案中，受其家属委托担任吴敏的辩护人。

I am Zhang Qingfang, an attorney from Handing United Law Firm in Beijing. I am currently serving as the defense attorney for Wu Min, the former director of the Ji'an People's Congress, who is being tried for bribery at the Yingtan Intermediate Court, entrusted by his family.

根据家属提供的十几份录音，鹰潭中院，鹰潭司法局为吴敏强行安插的法律援助律师，鹰潭华星律师事务所主任吴文兆，在代理本案过程中有大敬言论。

According to over a dozen recordings provided by the family, the Yingtan Intermediate Court and the Yingtan Justice Bureau forcibly assigned Wu Wenzhao, director of the Yingtan Huaxing Law Firm, as Wu Min's legal aid lawyer. During the case proceedings, Wu Wenzhao has made highly disrespectful remarks.

吴文兆多次对吴敏家属说：我也知道吴敏冤，这就是有人借刀杀人。但是，上边压下来，我也没办法。这就是个政治案子，薄熙来不也一样？一审，审出来一个清官。这又怎么样？这是政治。李XX总理不都死了嘛，你们还有什么想不开的！这都是政治。

Wu Wenzhao repeatedly told Wu Min's family, "I also know Wu Min is innocent; this is someone using others to carry out their schemes. But there's nothing I can do with the pressure coming from above. This is a political case. Isn't it the same with Bo Xilai? The first trial resulted in the exoneration of an innocent official. So what? This is politics. Premier Li XX has died, what more do you have to be confused about! This is all politics."

吴文兆明说前总理的死是政治的录音，我们手中有四份，都于2024年1月19号提供给了鹰潭中院和鹰潭司法局，鹰潭中院刘赛连副院长于1月22号明确说对吴文兆的言论已经在调查，鹰潭市法律援助中心也说对吴文兆已经立案调查。

We have four recordings of Wu Wenzhao stating that the former Premier's death was political, all provided to the Yingtan Intermediate Court and the Yingtan Justice Bureau on January 19, 2024. Liu Sailian, vice president of the Yingtan Intermediate Court, confirmed on January 22 that an investigation into Wu Wenzhao's remarks was underway, and the Yingtan Legal Aid Center also stated that a case against Wu Wenzhao had been filed.

但是，从立案到现在两个月过去了，从没见鹰潭中院和鹰潭司法局找提供吴文兆大不敬言论录音的吴敏家属来核实真伪。

However, two months have passed since the filing, and there has been no attempt by the Yingtan Intermediate Court or the Yingtan Justice Bureau to verify the authenticity of the recordings of Wu Wenzhao's disrespectful remarks with Wu Min's family.

本律师认为，按司法部，各级司法局给律师的政治学习材料中的标准，吴文兆在吴敏家属面前讲的政治谣言，在古代就是大不敬罪，是灭九族都不够，要灭十族的，这种案子，地方官都不敢审，要马上押解京城，交朝廷处置。

As a lawyer, I believe that according to the standards in the political study materials provided to lawyers by the Ministry of Justice and justice bureaus at all levels, Wu Wenzhao's spreading of political rumors in front of Wu Min's family would have been considered a crime of extreme disrespect in ancient times, warranting the extermination not just of nine, but of ten family generations. Such cases would not be adjudicated by local officials but would be sent directly to the capital for the imperial court to handle.

按现在的标准，至少也是严重违犯执政党的政治规矩和政治纪律的行为，甚至构成刑法分则第一章中的某些条款。

By today's standards, this would at the very least be a serious violation of the ruling party's political rules and discipline, even amounting to certain provisions in the first chapter of the criminal law.

对于如此严重的违法违纪甚至犯罪行为，是谁给鹰潭中院田甘霖院长、刘赛连副院长，鹰潭司法局赵勇凯局长的胆子，竟敢明着说已经立案调查，实则根本不启动调查工作，就这样以拖延包庇吴文兆，对人民领袖不忠诚不老实，做政治上的两面人？

For such serious violations of the law, discipline, and even criminal acts, who gave the courage to Tian Ganlin, president of the Yingtan Intermediate Court, Liu Sailian, vice president, Zhao Yongkai, director of the Yingtan Justice Bureau, to boldly claim that an investigation has been initiated, when in reality, no investigative actions have been taken, thus delaying and covering up for Wu Wenzhao, being unfaithful and dishonest to the people's leaders, and acting as a political two-faced person?

我不能不怀疑，以吴文兆的律所就和鹰潭中院在一个大院，以吴文兆和鹰潭司法局局领导，法律援助中心熊华祥主任的亲密关系，他口中的这样政治谣言，就是来源于田甘霖刘赛连赵勇凯熊华祥等人。

I cannot help but suspect, given the close proximity of Wu Wenzhao's law firm to the Yingtan Intermediate Court, and his close relationships with the leaders of the Yingtan Justice Bureau and Xiong Huaxiang, director of the Legal Aid Center, that such political rumors he spread originated from Tian Ganlin, Liu Sailian, Zhao Yongkai, Xiong Huaxiang, and others.

现在，本律师正式要求鹰潭纪委对吴文兆的大不敬言论，对田甘霖等人包庇吴文兆的行为立即展开调查并做出严肃处理。

Now, I formally request the Yingtan Discipline Inspection Committee to immediately investigate Wu Wenzhao's disrespectful remarks and the actions of Tian Ganlin and others in covering up for him and to take serious action.

你们不调查不处理，不及时公布调查处理结果，本人就一级一级地上告。

If you do not investigate and handle this matter, and do not timely announce the results, I will escalate my complaints level by level.

如果各级衙门都不认为吴文兆的言论是个事，也是为中国人民的言论自由开拓了空间，本人对这个可能的结果，也是乐观其成。

If all levels of government do not see Wu Wenzhao's remarks as an issue, it would also be expanding the space for freedom of speech for the Chinese people, which I would view optimistically.
