I am Zhang Qingfang, a lawyer at Beijing Handing United Law Firm, and I’m defending Xu Wei against the charges you’ve brought forward, including gambling, causing trouble, and occupational embezzlement. I’m writing to encourage you to either file additional charges against Zhang Jiaming, who is implicated as a whistleblower in this case, for his suspected illegal activities, including public deposit fraud and occupational embezzlement, or to consider resigning or turning yourself in. This suggestion is made with your best interests in mind, and I hope you’ll quickly make the right decision.

I believe you are well aware of Zhang Jiaming's crimes, but still, I find it necessary to list them as follows:
1.张家明在2006年至2012年开发安徽国际五金商贸城（简称“五金城”）项目以来，采用非法向不特定人群借款及虚假联建协议销售房屋优先购买权等方式，非法吸收公众存款，数额特别巨大，构成非法吸收公众存款罪。
1. Since the development of the Anhui International Hardware and Trade City (referred to as "Hardware City") project from 2006 to 2012, Zhang Jiaming has been involved in illegal borrowing from the public and selling house priority purchase rights through fake joint construction agreements, illegally absorbing public deposits with an exceptionally large amount, constituting the crime of illegal absorption of public deposits.
自2006年以来，张家明以开发明利公司房地产项目五金城名义，采取了向社会上不特定人群借款的方式，以及和不特定人群采用签署联建协议销售房屋的优先购买权等方式，许以高额利息，非法募集资金用于个人使用及房地产项目开发，期间涉及到不特定人群数千人，非法募集资金共达二十多亿元。
Since 2006, under the guise of developing the Mingli Company's real estate project, Hardware City, Zhang Jiaming has borrowed from unspecified groups of people and sold house priority purchase rights through joint construction agreements, promising high interest rates, illegally raising funds for personal use and real estate project development, involving thousands of unspecified individuals, and illegally raising more than two billion yuan in total.
上述非法吸收公众存款的事实，在2011、2012年后因张家明无法返还借款及利息，造成数千人多次上访，引发大规模群体性事件，社会影响特别恶劣。时至今日，仍有大量债权无法偿还。
The aforementioned facts of illegal public deposit absorption led to thousands of petitions after 2011 and 2012 due to Zhang Jiaming's inability to repay loans and interest, causing large-scale group incidents with particularly adverse social impacts. To this day, a large amount of debt remains unpaid.
张家明的上述事实构成非法吸收公众存款罪，且数额特别巨大，情节特别恶劣，应予严惩。
The facts mentioned above about Zhang Jiaming constitute the crime of illegal absorption of public deposits, with an especially large amount and particularly severe circumstances, warranting severe punishment.
2.张家明在担任明利公司法定代表人及实际控制人期间，采用签署虚假联建房协议等形式，非法占有明利公司商铺100套及9000平方米商铺，构成职务侵占罪。
2. While serving as the legal representative and actual controller of Mingli Company, Zhang Jiaming, through signing fake joint construction agreements, illegally possessed 100 shops and 9000 square meters of commercial space of Mingli Company, constituting the crime of occupational embezzlement.
2011年，张家明控制明利公司期间，指使公司会计赵梅等人，采用签署虚假联建房协议的形式，以自己的亲戚朋友的名字和明利公司签署联建房协议，出具虚假的现金收据，将明利公司100套房产转移到自己亲朋好友名下50套，转移到胡晓峰亲友名下25套，转移到许威亲友名下25套，转移到贾贤林名下9000平方米商铺。
In 2011, while controlling Mingli Company, Zhang Jiaming instructed the company's accountant Zhao Mei and others to sign fake joint construction housing agreements in the names of his relatives and friends with Mingli Company, issuing fake cash receipts, transferring 100 properties of Mingli Company to 50 in the names of his relatives and friends, 25 to Hu Xiaofeng's relatives and friends, 25 to Xu Wei's relatives and friends, and 9000 square meters of commercial space to Jia Xianlin.
张家明在管理明利公司期间，采用虚假合同的方式，将公司资产转移到自己及他人名下，非法占有公司资产，构成职务侵占罪，数额特别巨大，应予严惩。
While managing Mingli Company, Zhang Jiaming transferred company assets to himself and others through fake contracts, illegally possessing company assets, constituting the crime of occupational embezzlement, with a particularly large amount, warranting severe punishment.

综上，十几年来，张家明的行为已经过多次公安机关调查，多个明利公司的涉案案件中张家明的非法吸收公众存款和职务侵占的案件证据确凿，所有涉案的借款人、财务人员也已经经过合肥市公安局、包河区公安局、蜀山区公安局调查取证多次，财务帐、虚假合同、虚假收据、对应商铺名称等书证物证人证确凿，犯罪事实清楚。
In summary, over the past decade, Zhang Jiaming's behavior has been investigated multiple times by the police. The evidence in the cases involving Mingli Company's illegal absorption of public deposits and occupational embezzlement is conclusive. All involved borrowers and financial personnel have been investigated multiple times by the Hefei City Public Security Bureau, Baohe District Public Security Bureau, and Shushan District Public Security Bureau. The financial accounts, fake contracts, fake receipts, and corresponding shop names provide conclusive documentary and physical evidence, and the criminal facts are clear.
黎俊检察官，在办理许威案中，我不好奇你对许威不构成犯罪的事实仍然提起诉讼，但我好奇的是，案卷中已经有如此确凿的证据，证实了张家明的非法吸收公众存款和职务侵占的犯罪事实，且情节特别恶劣，你为何视而不见置若罔闻？如果你看不出张家明构成犯罪必须补诉，说明你是个如假包换的法盲，我就建议你立即辞职，不要赖在检察官的位置上继续制造冤案。如果你明知张家明有罪而不补诉，则已经构成徇私枉法，请你尽快自首，还能争取从轻处罚。
Prosecutor Li Jun, in handling the Xu Wei case, I'm not curious why you still brought a lawsuit against Xu Wei despite the fact not constituting a crime, but I'm perplexed by your apparent disregard for the overwhelming evidence in the case files that clearly demonstrate Zhang Jiaming's illegal activities, including the illegal absorption of public deposits and occupational embezzlement. Given the gravity of these offenses, your choice to ignore them is troubling. Should you fail to recognize Zhang Jiaming's actions as criminal, necessitating additional charges, it suggests a profound lack of legal understanding on your part, prompting me to recommend your immediate resignation to avoid further miscarriages of justice. If you are aware of Zhang Jiaming's guilt yet choose not to act, you're essentially manipulating the law for personal benefit. I urge you to come forward and surrender, potentially mitigating your punishment.
黎俊检察官，我相信，你和其他很多检察官一样，都受制于公安的强势，工作中抱着多一事不如少一事的态度，对公安移送来的案件，不敢坚持原则，但是，在本案中，你遇到了一个愿意为中国法治付出代价的较真律师！
Prosecutor Li Jun, it seems to me that you, like many of your peers, are swayed by the police's influence, choosing the path of least resistance in your duties rather than standing firm on legal principles when dealing with cases forwarded by the police.
